legal downloads

Endalon only sells legal downloads, meaning all sounds, samples, loops, midi’s, templates, songs and/or other audio-related products sold here are produced, recorded or otherwise acquired by Endalon with a full license to distribute. All such audio products are afforded to you with license to reuse, repurpose, reprocess or otherwise rework into commercial products and/or services, maintaining full master-, author- and copyright, as detailed by their respective licenses. None of these audio products can be redistributed as such. The sole distribution license for each product lies with Endalon, and attempts to redistribute these products will be met with legal action.

The respective licensing agreement for each individual product is listed on the webpage of the product. A copy of the respective licensing agreement will be provided with each product in your purchase. It is up to you, the end user, to thoroughly read, accept, and adhere to the relevant licensing agreement(s) for the products in your purchase. If you are unsure about which licensing agreement(s) apply to your product(s), please contact us before making a purchase.

What is Endalon?

Endalon is registered at The Netherlands Chamber of Commerce with SBI code 88839672 and The Dutch Tax and Customs Administration with VAT number NL004669192B73. Founded in 2023 we specialize as a Sample Developer and Distributor. If you have any questions about our products, then please do not hesitate to contact us.

Buying Downloads

The “Downloads” we sell are “Products” in digital format that are transferred from our server(s) direct to your computer. These Products are compressed into ZIP/RAR files (made smaller using compression software) to enable faster downloading. If you are unsure about how to decompress our products, then please contact us for assistance.

Transactions

All transactions are run through the respective payment processor of your choice. All purchases are non-refundable unless specified otherwise. VAT may be included where applicable.

Intellectual Property Rights

All Products, MP3 Demos, Materials, Artwork, Graphics, Text, Interfaces, Logos, Images and Photographs on this website are owned or licensed to Endalon and protected by copyright and intellectual property rights laws. We sell Products from third-party manufacturers and the right to sell these Products (and to display their product information and materials) has been obtained from the relevant manufacturers.

Refund Policy

Under the Distance Selling Regulations, you would normally have the right to cancel the contract of sale within seven days. However, this does not relate to software goods or downloads, which cannot be returned. You do not have the right to cancel an order once the Product has been downloaded. This does not affect any other rights that you may have.

Privacy

By using Endalon.com, you consent to the terms of our Privacy Policy.

restrictions

You are not permitted to make copies of the Products you’ve purchased with the intention to give, sell, loan, broadcast, send or transmit products to friends and family or anyone else, as these acts breach international copyright laws.

You may not upload the Products you purchase to file-sharing sites, torrent sites, Peer-2-Peer sites, Crack or Warez sites. We reserve the right to share your details with any sample pack label or manufacturer which holds copyright for a product which you have illegally shared. You may not resell the sample packs or sounds you buy from this website to any third party, as the license for these products is non-transferable. 

Some music software products include a license which can be transferred. Please check the terms and conditions of the license included with the software for further details, or contact us at [email protected] if you wish to clarify the terms of a software license agreement.

exclusions

We will do everything in our power to ensure that this website is operational 24 hours a day, 365 days a year. However, we make no guarantees about the availability of our service. Endalon shall have no liability for your Products once the Product is transferred to you. It is your responsibility to backup the Products you buy from Endalon. 

limitation

We exclude all liability and responsibility for any loss incurred by you or a third party in connection with this website or the Service we offer, including but not limited to loss or damage due to viruses that affect computer equipment, software, data or other storage devices on account of your access to, use of, or browsing this website or your purchasing and downloading of materials and Products from this site.

We further exclude all liability and responsibility for any and all legal disputes that arise as a result of using our Products. All legal defense is in the sole custody of the Consumer. Please save any and all License Agreements for our Products to that end.

governing law

The laws of the Netherlands govern these Terms and Conditions. Your use of this website may also be subject to other local, national, or international laws. You expressly agree that exclusive jurisdiction for any claim or dispute with Endalon relating in any way to your use of the Service shall reside in the courts of the Netherlands.

miscellaneous

If any part of these Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

Endalon’s failure to enforce any provision in these Terms and Conditions will not constitute a waiver of such provision, or any other provision of these Terms of Service. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the other provisions will remain in full force and effect.

indemnification

You agree to indemnify, defend and hold us harmless, from and against any and all claims, liabilities, damages, losses and expenses, relating to your violation of these Terms and Conditions, and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.

errors/omissions

Whilst we endeavor to ensure that the information provided on this website is complete and correct, we do not warrant the accuracy and completeness of the Content. Furthermore, we reserve the right to make changes to the Content, or to the Products and prices described, at any time and without notice.
